Joint Medicaid Oversight Committee:
Behavioral Health Redesign Beta Testing Part II

On November 16, the Joint Medicaid Oversight Committee (JMOC) met to revisit the topic of beta testing Ohio's Behavioral Health Redesign. This time, in addition to a presentation by Medicaid Director Barbara Sears and other Kasich administration staff, JMOC heard from the Ohio Association of Health Plans (OAHP), The Ohio Council of Behavioral Health & Family Services Providers (which represents about 150 behavioral health providers), as well as a few providers themselves.

As Director Sears explained, beta testing has commenced for 179 of the 437 agencies impacted by redesign (about 41 percent), 98 percent of tested fee for service claims are being properly processed, and they have had similar success with MyCare plans, including achievement of network adequacy. OAHP, which represented Managed Care Organizations (MCOs), advanced a similar narrative, describing their efforts to close gaps in service, work on contracting with providers, and provide resources to educate and enhance providers understanding of the new system. The testifying providers, on the other hand, had a greater range of opinions on the progress of Redesign.

The New Rules of Waivers and State Plan Amendments

On Tuesday November 7th, the federal Department of Health and Human Services outlined its new criteria for reviewing states’ efforts to experiment with their Medicaid programs. In a press release sent out by the Centers for Medicare and Medicaid Services (CMS), Director Seema Verma outlined her “vision” for the Medicaid program, which includes a new approach to 1115 Demonstration Waivers, their associated review and implementation processes, as well as changes to the review of State Plan Amendments and the creation of Medicaid “Score Cards.”

To gauge the strategic intent of any organization, it is important to understand the vision of that organization and the principles inherent in that vision. In the context of CMS and Medicaid, the Director wants to “reset the federal-state partnership” and “not accept the hollow victory of numbers covered.” Notably, the Director’s focus on beneficiaries involves having enrollees achieve their “highest potential,” stating “CMS believes that meaningful work is essential” and that “every American deserves the dignity and respect of high expectations.” This vision is communicating a different idea about Medicaid as an entitlement, using Departmental authority to renegotiate the responsibility of enrollees in achieving coverage. Joint Medicaid Oversight Committee: Medicaid Budgeting and the Behavioral Health Redesign

On September 21, the Joint Medicaid Oversight Committee (JMOC) met to discuss the state budget process and the Behavioral Health Redesign and, on September 22, the state convened one of its regional forums on the redesign for providers. These two events can demonstrate how policy is discussed in the context of committee and the practical effects these discussions may have on the behavioral health system.

In JMOC, Directors Barbara Sears and Tracy Plouck presented on the Medicaid budget and the behavioral health redesign. To frame the conversation, the administration presented its current biennial funding scheme as a “gap,” citing the lack of policy tools authorized by the General Assembly in the most recent budget process. As they explained, cuts to hospital rates and adjustments to hospital supplemental payments and managed care were necessary to achieving budget neutrality in the appropriation expectations set by the legislature. This framework was not well-received by members of JMOC who made claims that the acceptance of the budget by the governor may be unconstitutional, that efforts to control costs could be made at the expense of providers and the clients they serve, and that the Ohio Department of Medicaid did not have the adequate legal authority to change payment rates. Specifically in regard to redesign, several members voiced concerns that the current budgeting proposal, and the redesign itself, could cause complications in the delivery of care for individuals with mental illness or substance use issues.

Senate Veto Overrides:
Implications for Ohio’s Medicaid Program

CONTEXT
On Tuesday, August 22, the Senate voted to override six of Governor Kasich’s Medicaid-related vetoes. In July, the House had overridden 11 of the governor’s vetoes, 10 of which dealt with Medicaid, meaning that the Senate can still act on four of those Medicaid-related provisions pushed forward by the House. Several of the veto overrides included provisions that would affect eligibility, rates, and the carve-in of certain Medicaid populations into managed care.

JMOC Hears Testimony from ODM, ODMHAS, and Behavioral Health Providers as Redesign Implementation is Delayed

After over two years of preparing to carve new behavioral health benefits into Medicaid managed care plans and recode all Medicaid behavioral health services to align with national coding standards, the Ohio Departments of Medicaid (ODM) and Mental Health and Addiction Services (ODMHAS) had announced they were ready to go live with the Behavioral Health Redesign starting on July 1, 2017. The agencies filed rules implementing the changes with the Joint Committee on Agency Rule Review (JCARR) earlier this spring after the Common Sense Initiative Office ruled the rules would not have an adverse impact on business. However, after hearing from numerous small providers that were unprepared to go forward with the new system on July 1, the Ohio House of Representatives inserted a provision in the budget bill (H.B. 49) that would prohibit the new system from going live until January 1, 2018, and further delay the carve-in of alcohol, drug addiction, and other mental health services into Medicaid managed care until July 1, 2018. Correspondingly, JCARR requested that the administration place its proposed rules in “To Be Refiled” status to allow for further review.

On Thursday, June 22, the Joint Medicaid Oversight Committee (JMOC) of the Ohio General Assembly heard testimony regarding the status of the Behavioral Health Redesign from ODM Director Barbara Sears, ODMHAS Director Tracy Plouck, and representatives from various behavioral health providers. Directors Sears and Plouck testified that the administration is respectful of the budget deliberation process and that the agencies will not refile rules affecting community mental health providers nor propose an effective date for the rules until the budget process has concluded. However, Director Sears affirmed that the hospitals are prepared to move forward with the coding changes and make the new services available as soon as possible. Therefore, ODM has refiled a rule to increase access to services for children and multi-system youth with an effective date of August 1, 2017. Director Sears noted that ODM is able to accommodate these new services sooner because the billing methodology for hospitals in the Medicaid claims system is separate from the coding changes relating to community providers.

Managed Long-Term Services and Supports Second Workgroup Meeting: What’s to Come?

On Tuesday, May 30, 2017, the Department of Medicaid, with the assistance of the Department of Aging, convened a workgroup meeting for the implementation of the Managed Long-Term Services and Supports (MLTSS) program.

The meeting was the second time the workgroup convened and was used to update stakeholders on the current endeavors in preparation of the program’s rollout. Both departments highlighted their continued commitment to working with stakeholders during the rollout of the MLTSS program, emphasizing their belief that MLTSS will be helpful in improving the quality of life for the individuals the program serves.  Stakeholders were given nearly half of the meeting to ask questions on implementation and the rollout.

State Budget Update: Medicaid Changes in House Substitute Bill

With the budget in full swing, the Ohio House has offered its first amendments to the governor’s proposed budget. This action is the first in a multi-step process that will soon include another round of consolidated amendments (Omnibus) before it is voted on by the full House and sent to the Senate. Even though we are early in the process, there have been a number of dramatic changes proposed. To assist policy analysts and advocates with learning more about each of these initiatives, the Legislative Service Commission’s Comparison Document (“Comp Doc”) code will be cited to make the information on the changes easier to find.

Since the beginning of the Kasich Administration, the Office of Health Transformation (OHT) has focused on value-based payment as a key element of its reform efforts. These policies have included two main activities in the construction of episodic-based payments and the proliferation of patient-centered medical homes (PCMH) through the Comprehensive Primary Care Initiative (CPC). With CPC, OHT is working to enroll primary care practices into a system built on the clinical coordination of care, with the transparency of cost and quality being a mechanism through which enhanced reimbursement would be attached and incented. Now, the Medicaid director, and by proxy OHT, would no longer be permitted to implement this system, but would also lose authority in establishing PCMH services for the developmentally disabled.

County Council HHSA Committee Hears Contract Extensions, State Budget Update, Medicaid and More

Tom Pristow, director of the Cuyahoga County Department of Health and Human Services, presented a budget allocation approval request that increased the amount distributed for the Cuyahoga County Tapestry System of Care from $5.7 million to $8.1 million. The Cuyahoga County Tapestry of Care is a partnership with government and non-government agencies to create a system for youth to receive wrap-around support services. The goals include reducing recidivism for youth back into county custody, as well as improved family and youth functioning. Councilwoman Shontel Brown asked Director Pristow the reason a change is needed, and Director Pristow replied that it is due to a reformulation of the referral process. Initially, the projected need for the agencies was lower than expected, so a decreased amount was requested by HHS. However, a recent evaluation of the service projections changed the forecast and, thus, a request for restoration of the original funding amounts for the six agencies. Applewood Center, Inc. received an additional $460,324, BeechBrook received an increase of $418,477, Catholic Charities Corporation (Parmadale) received an increase of nearly $1.2 million, and Pressley Ridge received an increase of $338,204. Bellefaire and OhioGuidestone did not see funding increases. Chairwoman Yvonne Conwell noted that many of the organizations in the Tapestry Program were given an “average” grade. She wondered why and how each organization is evaluated to merit each grade. Councilwoman Conwell shared that she would like to see uniformity in agency evaluation in the future. Councilwoman Brown asked Director Pristow for more data on which agency has received what amount from past years, so that it creates context for the amounts being requested, to which Director Pristow agreed. The contract modification was passed out of the HHSA Committee to the full council for consideration.

JMOC: The Medicaid Group VIII Assessment Findings and Highlights on the Medicaid Portion of the Executive Budget

Director Barbara Sears cemented her first 56 days as Director of the Department of Medicaid by briefing the Joint Medicaid Oversight Committee (JMOC), a committee she once chaired, on the Ohio Medicaid Group VIII Assessment (Expansion) report and Medicaid highlights from the executive budget, House Bill 49.

The Medicaid Group VIII Assessment report highlights key findings from an examination on Group VIII, otherwise known as the Medicaid expansion population in Ohio. A large sample size was used to gather data to examine, from a wide variety of sources and through biometric screenings, medical records, Medicaid records, focus groups and stakeholder interviews.

When debating the Medicaid expansion in 2013, the Ohio legislature appropriately questioned whether expanding the program to non-disabled adults would be done so efficiently, supporting the health, welfare, and economy of Ohio and its citizens. The subsequent policy process reflected this focus on program performance, including a legislative committee tour around Ohio to understand the potential impact of expansion, the creation of the Joint Medicaid Oversight Committee, legislative efforts to increase cost-sharing for participants, and an evaluation of the impact of the expansion due 2017. It is this last item, the “Ohio Medicaid Group VIII Assessment” evaluation, which is the subject of this blog.

Medicaid is big and complicated. As I have written about before, the intertangled state and federal monies, processes, and policies that comprise the Medicaid program vary greatly from state to state and, as the saying goes, if you’ve seen one state Medicaid program, you’ve seen one state Medicaid program. With that said, Medicaid occupies a greater share of state and federal budgets, and it is a target of reform on both levels of government. Indeed, with an emboldened Congress and a new administration, changes are coming, and those changes create opportunities and challenges for policymakers. Given this complex relationship, federal policy cannot remain agnostic to the variation of state design.

JMOC: Setting the Rate

            In September, the Joint Medicaid Oversight Committee (JMOC) met to discuss the preliminary report from the JMOC actuary, Optumas. During that meeting, Optumas laid out the basic process for determining the JMOC per member per month (PMPM) growth rate, and there was a review of the statutory obligations of JMOC when setting said rate. JMOC: Preliminary Report from the Actuary

               It has been a couple months since the last Joint Medicaid Oversight Committee (JMOC) hearing, and the latest meeting covered a lot of ground in a five-hour-plus session. The majority of JMOC dealt with the behavioral health redesign, including testimony from providers and the administration. If you want to learn more about what was shared during that portion, I recommend you read the following post from Kelly Smith of the Mental Health and Addiction Advocacy Coalition. For my blog, I will focus on the preliminary report from JMOC’s actuary, Optumas. While it may not have had the depth of content (or attendance) as the “redesign” section, the implications of what was shared may have a more significant impact in the next budget, generally.

            According to Ohio Law, at the beginning of every fiscal biennium, JMOC must contract with the actuary to provide a projected medical inflation rate, determine if it agrees with the projection, and submit a report on its findings to the Governor and the General Assembly (GA). If JMOC doesn’t agree with the projection, they must develop their own rate for the submission. This report will be submitted October 25th, to comply with the requirement to have it to the Governor 90 days before he submits a state budget proposal for the upcoming year (at least January 23, 2017).

Census Review: 
The Impact of the Affordable Care Act on the Uninsured

The Center for Community Solutions team has been analyzing the implications of the latest U.S. Census information. To learn more about this data more broadly, please click here to see the blog post by Kate Warren. With that said, I wanted to dive a bit more deeply into one set of metrics around the uninsured and the policy underpinnings that have led to the current data measurements.

The census data revealed that Ohio’s uninsured rate continues to decrease, showing a reduction of the uninsured by over 500 thousand since 2013. In just five years, Cuyahoga County has seen its uninsured rate cut in half (12.5 percent uninsured in 2010 to 6.1 percent in 2015), and Cleveland’s uninsured rate has dropped nearly 10 percentage points over the same period. This decrease is attributable, in large part, to the passage of the Patient Protection and Affordable Care Act (ACA) which provided coverage through an optional Medicaid expansion and the creation of the Health Insurance Marketplace (Marketplace). The effects of these two aspects of the law, however, are not limited to their existence and, in fact, the two have shown to have significant influence on one another.

Ohio Announces Initial Approval of HCBS Transition Plan

On Monday, June 6th, the Ohio Office of Health Transformation released a statement announcing the recent initial approval of the state’s Home and Community-Based Services (HCBS) Transition Plan, by the Centers for Medicare and Medicaid Services (CMS). The plan, submitted originally in March, 2015, was developed in response to new CMS rules for states operating 1915(c) HCBS Medicaid waivers. The new rules are intended to increase the quality of HCBS settings, enhance person-centered planning, and maximize opportunities for waiver participants to interact with the community and live and work in the most integrated settings possible (see text box for details). In short, states may not use federal Medicaid funds to support HCBS settings that do not comply with the new rules and that have institution-like qualities. These regulations have garnered significant attention from providers, consumers, and family members as they will have a substantial impact on adult day programs, sheltered workshops, and HCBS residential settings.

JMOC: Redesign Update and Panel Discussion

During the meeting, which featured a panel of experts in the field, there were two main points of conversation. An Update on the Extension of Medicaid

Ohio’s Medicaid extension has received a lot of scrutiny from the media, policymakers, and policy experts since its implementation in 2014. This scrutiny has only increased in the past few months during Governor Kasich’s Presidential run and as the Ohio Department of Medicaid (ODM) finalizes its statutorily required 1115 demonstration waiver, Healthy Ohio. While many have been extolling the value of the program, including the Governor, some have claimed that the costs associated with the extension are exorbitant, resulting in overspending in the Medicaid program.
